Legal Question in Family Law in Oregon
If a child is receiving social security disability should I be charged full child support?
1 Answer from Attorneys
ORS 25.275(4)(b) says:
The child support obligation to be paid by the obligor * * * may be reduced dollar for dollar in consideration of any Social Security or apportioned Veterans benefits paid to the child, or to a representative payee administering the funds for the childs use and benefit, as a result of the obligors disability or retirement.
So..... if the child is receiving Soc. Sec. "child's benefits" as a result of the your own entitlement to Soc. Sec. disability benefits, you would be entitle to a dollar-for-dollar offset (or credit) against you child support obligation.
