Child support. My moms ex-doesnt want to pay.

My mother lives in Oregon.

She just divorced my step father, they have a son together,

he's 13 years old.

My mom makes $200 more then he does. She's raising the boy.

The ex claims he is not required to pay one cent, because of

she makes more.

Is that correct?

Child support obligations under Oregon law.

ANSWER: No.

Under Oregon law, BOTH parents have a duty to contribute to the support of their child. The noncustodial parent fulfills his duty of support by paying to the custodial parent his share of the "total support amount." The noncustodial parent's share is based on his income and its percentage relationship to the total combined income of both parents. If the custodial parent earns more income than the noncustodial parent, it will have some effect on the amount of his obligation but he will still have an obligation to pay his "fair share."
