My ex and I have two children..as of 1999 one child is living with me and one with him

He makes at least 2 times what I am making and I wanted to know if he should have to pay child support?

Child Support Payments when each of us has a child...

Your Question:

My ex and I have two children..as of 1999 one child is living with me and one with him He makes at least 2 times what I am making and I wanted to know if he should have to pay child support? He feels since we each have one then there should not be any support.

ANSWER:

The Oregon Child Support Guidelines refer to your situation as being a split custody arrangement for child support calculation purposes. A special calculation is used for split custody. In essence, the formula calculates a support obligation for each parent; what each parent owes to the other for the child residing with the other parent. Then the smaller number (usually attributable to the lesser-earning parent) is offset against the larger (usually attributable to the greater-earning parent) so that only one parent actually pays dollars to the other.

You will find an on-line Oregon Child Support Calculator at the following website:

http://dcs.state.or.us/calculator

The applicable OAR (Oregon Administrative Rule) for SPLIT CUSTODY is found on-line at http://arcweb.sos.state.or.us/rules/OARS_100/OAR_137/137_050.html

See, specifically, OAR 137-050-0460, which sets forth the prcoess to be follown in Split Custody cases,
