Common law marriage

My husband and I began living together in Oregon in 1975, and did so until 1984, we lived toether, and held out as we were husba nd and wife, On four occasions we went to Idaho, 1977 were of three days and then two trips of seven days , duration of each, one 1978 and one in 1979, ORegon recognizes, Idaho does not. we married in 1984????

Re: Common law marriage

You are not married in either Oregon or Idaho.

First, Oregon law makes no provision of establishing a "common law" marriage within this state. (However, Oregon will give recogniation to a common law marriage that has been established in another state, provided the other state's laws allow for the estabishment of a common law marriage.)

Visiting Idaho on four occasions between 1975 and 1984, and returning to Oregon (your place of permanent residence) at the conclusion of each visit, does result in the establishment of a common law marriage in Idaho.

Perhaps consideration should be given to getting a marriage license and having a wedding ceremony.
