Getting Custody of a grandchild

I would like a form for my son to sign that gives me legal custody of his son (my grandson). My son now has legal custody - the mother is not involved. It should basically say he will give me custody to make sure my grandon is taken care of while my son takes care of his drug problem. I would like it to mention or have a space for visitation agreement also. If you need additional information please email me

A formal guardianship should not be needed for the limited purpose you describe.

ORS 109.056 allows the parent of a minor child, by a properly executed power of attorney, to �delegate� to another person, for a period not exceeding six months, any or all of the powers of the parent regarding care, custody or property of the minor child, except the power to consent to marriage or adoption of a minor ward.

There is a form you can buy from the Stevens-Ness Law Publishing Co. in downtown Portland. It is Form # 1478: Delegation of Powers of Parent or Guardian.
