Dependent's Last Name Change

My wife and I divorced a long time ago when my 3 sons were young. She remarried a few years later and moved from Ca (where the divorce was finalized) to OR with my boys and her new family. I learned years later when the boys were grown that their last name was changed from mine to now their step-father's. This was only with my two youngest, my oldest son has kept my last name. This really came to surface when my youngest son joined the Army in 2005 and was KIA in Iraq in 12/2006. For him to retain his step-father's last name through the Army process, a legal document should've been submitted somewhere. Can I be directed somewhere to show me this can be done without my permission? Our divorce decree had no mention of name change for the boys and I never signed any documents to release my responsibility. I also paid child support through the time they turned 18. Any assistance would be helpful. I am just getting the run around from everyone concerned about this.

I'm very sorry for your loss. Your ex-wife would have had to go through the courts to get the name changed. If he was a minor, she would have had to have your signature of consent or indicate that she had no means by which to contact you and did not know where you were at that time. You should find where the name change was done and get the court records. Contact me if I can be of assistance.
