Divorce with Guardianship

My husband and I have been seperated for about five years now. I am looking to file a divorce. He still lives in Oregon and I now live in Montana. We have one daughter, we have signed guardianship to his mother about six years ago. How do I file my divorce papers? Do I include a divorce with children, or do I just file a standard divorce?

If you and he are both in agreement, the divorce action can proceed here in Oregon. You would be the petitioner; he would be the respondent. You could limit the proceding to "status only" divorce, meaning that the only think the court's judgment does is to terminate the marriage, thus changing the legal status of the parties from married to be be single.

Or you could have the divorce judgment include provisions dealing with other issues that are "incidental" to the termination of the marriage,such as custody, visitation, child support, property division, etc. Whether to deal with the issues or not is up to you.
