Legal Question in Family Law in Oregon

Divorce papers sent to Iraq

My son is in Iraq and just got Divorce papers that give him 20 days which to respond or it will be final and she will get everything she asks for. I have a POA how do I get an extention in order to have time to get him a Attorney?

Is the Wife represented by an attorney? First thing is to contact the attorney and let her know your son is in military. There is a Servicemembers act (a Federal law) that protects him from a default.

If she does not have an attorney, notify the court where she filed her papers that your son is overseas and cannot respond.

Also, in Oregon your son would have 30 days to respond after service. How was he served if he is overseas?
