Can my ex-boyfriend sue me for equity of my home?

The home, insurance and all bills are in my name. The entire downpayment was my money. He paid the mortgage and I paid all of the other household bills, for 2.5 years, as this was easier than splitting all of the bills. We were together for 5.5 years total and have no written agreement or contract.

Could a judge order me to split the equity that accrued while he was technically paying the mortgage? Could I be forced to refinance, or sell? He has retained a lawyer and I was just contacted informing me of his intent sue if his requests are not met. I am a single mother of two children (not his) and would not be able afford to refinance for the amount that he wants. Do I need a lawyer?

ANSWER:

Yes, a judge would have the authority to do that. But the more critical question is whether the judge SHOULD do that. And the answer to that question requires far more information and case analysis that can be provided here.

Not directly by court order. But the EFFECT of a court order (such as one that requires you to pay money to him) may result in your having no reasonable alternative other than sale or re-fi.
