Legal Question in Family Law in Oregon

Is this an exception for paying child support

mid march i met a girl at a party while drinking, and she got my number. later in the night after drinking more and also smoking, she texted me and asked if i would like to come stay the night. i responded, and eventually made it over that night. We had sexual intercourse without a condom while i was pretty intoxicated. she didn't have any drinks.

we stayed in touch and a few nights later i meet up with her and we have intercourse again, this time with a condom. After this night i dont see her for a few more days and then tell her i dont think its going anywhere and i break up. I had decided it was time to move back into my parents home and start school again, quitting drinking/drugs. this was around the end of may.

So, come april 20th, i get a text msg on my phone from her to call her. I call and ask whats the issue, and she tells me she's late and might be pregnant. When i bring up the fact that I'm not ready for a child and that she needs to have an abortion or put it up for adoption, she informs me that she is heavily against both options. She swears she wont have me pay child support. Is this legal, or is there any other way to avoid me being responsible for this child? do i have any options?

ANSWER:

No, you don't have any options, at least not any longer. You DID have options, but you failed to exercise them in a timely manner. And now it is too late.

Stated differently, you HAD to option to not have a child but did not avail yourself of that opltion when you could and should have done so. That is NOT the woman's fault, not the fault of the booze. It is YOUR fault. As matters now stand, the woman now has the sole and exclusive legal right to exercise the option to give birth or not, as she decides.

In essence, you have a legal right not to have a child. So, too, does the woman. However, the timing as to when YOU decide not to have a child is different from the timing of when a woman can choose not to have a child. This not the result of the laws enacted by the Legislature. Rather, this is because of the laws of Nature.

Next time you will know better.

PS: After the child is born, be sure to have blood tests done before you sign any legal papers or make any admission of paternity.
