Legal Question in Family Law in Oregon

Ex-girlfriend entitled to half of ex-boyfirend's house?

I lived with the father of my child for 12 years, 3 in Oregon where we purchased a home, in his name only. We have split up and he is going to sell the house. Am I entitled to any money from the sale? We were not married and the house is in his name.

It depends. Did you exist only as boyfreind and girlfreind or could you describe the relationship as common law marriage. There are numerous ways to prove common law marriage and they may or may not apply to your situation. Such as did you present yourself as a committed couple? Did you maintain joint accounts and joint residences? Did you support one another? Did you comingle funds to purchase the house or to manage the household? And so on.

Very likely you may be entitled to proceeds in addition to child support. But if he decides to fight you it will not be an easy fight.

Simply put you need a lawyer who specializes in family law to help you through this matter. You need to prove a need for a division of assets.

You may be entitled to an equitable division of his property as a dissolution of a domestic partnership.

It is also important that you establish you rights regarding the custody of your child. I suggest that you contact an attorney in order to be advised of your legal rights.
