Legal Question in Family Law in Oregon
Ex-wife is moving out of the country with my 2 childeren
My ex-wife has ''custodial'' custody and I have ''non-custodia'' custody. I have guarenteed parental time every other weekend and the divorce decree is very specific as to when and where we meet to exchange the childeren. However my ex-wife has informed me in writing that she is going to take both of our childeren with her to live with her boyfirend who resides in Canada.
I am afraid I will never see them again.
What can I do to keep that from happening? Any advice will help.
She has given me notification in writing with a 60 day time frame but is she required to file that with the court as well?

You should retain an experienced family lawyer to file a motion for modification of your parenting time so that specific times and other details will be set by the court. Along with the court filing you should try to settle the issues with a stipulated agreement through a mediator which may be quicker and less expensive than taking it completely through the court process. It is my understanding that Canadian courts will generally enforce parenting time orders from U.S. State courts.
