Legal Question in Family Law in Oregon

my ex-wife's portion of my pension

I have been working this job for 22years. I plan to retire in 5-6 years. I was married for 12 of those years. What does Oregon law dictate for my ex-wife's percentage of my pension when I retire? How much of it will she get?

Re: my ex-wife's portion of my pension

Absente unusual circumstances, She would generally be awarded 50% of that part of a defube benefit pension plan benefit that is attributable to the years of marriage.

EXAMPLE: You retire after 28 years of participation in the pension plan. You were married for 12 of those years. Assuming this is a defined benefit plan, she would generally be entitled to 50% of 12/28 of the dollar amount of your pension benefit, based on a single life annuity.

$(monthly benefit at retirement) x 12/28 x 50% = Alternate Payee's award.
