Legal Question in Family Law in Oregon

Family Law, as heard in hiphop songs:

I've been paying child support for 8 years, and have recently found out the child isn't mine (her mother told me). Gov't has taken my driver's license and refused passports, and will not issue them for a work-only basis, because (here's another complication) one company who was handling payroll deduction for said child support never sent a check before fleeing the country. Apparently he did this to many.

How can i restore my life and career?

Your situation is difficult. Many more facts are needed to advise you regarding your options. A review of the circumstances under which the support order was made would have to be reviewed. The facts surrounding the withholding of support from your wages would also need to be reviewed. Filing a motion to restore your driver's license should have a good chance of being successful.

Much depends on just how it came to be that you were established as the child's legal father. Was it because you and the mother were married to one another? Or was the child born out-of-wedlock and you then signed a Voluntary Acknowledgment of Paternity form? Or was there some legal paternity establishment proceeding that resulted in your being declared as the child's father? Were blood tests ever done? And, also, in which state was it (California or Oregon) that the support order was established?

If California, contact Lyle Johnson. If Oregon, call me. Under certain circumtances, a voluntary acknowledgment can be challenged and vacated if it was the result of fraud, duress or material mistake of fact. Other laws may also come into play.

Bottom line: Have your case reviwed by a lawyer who is familiar and experienced with paternity disestablishment laws and procedures.

(PS: Do keep in mind that lawyers, like most other people, are unwilling to work without being paid. And most require some or all of the payment to be made in advance. Keep this in mind before calling the lawyer.)
