My son believes that ex-girlfriend had a child from him, but has a boyfriend during during the whole time of pregnancy's, he thinking the child was his and when the child was born, it was a different story, see her boyfriend is of color and my son is latino, well this child looks just like my son, mother and boyfriend know its my son's but does not give him time or day to be a father to this child, what will be the right direction for legal custody of this child? Thank you

The biological father of a child born to an unmarried woman is, in the eyes of the law, a "nonentity" until and unless his legal paternity of the child is declared or established through one of the several recognized legal methods for doing so. Until then, he has no legal rights (and no legal responsibilities).
So --- first things first --- the biological father must first have himself declared as being the child's "legal" father. Most likely, this will require that he file with the court a "Petition to Establish Paternity." Once legal paternity has been established, he will then have legal standing on which to seek custody or visitation rights.
