Guardianship or cusdody

I pretty much raised my nephew from birth, but his mother will not let us have custody or guardianship of him, what can I do. I shoplifted about 20yrs ago and will that be a problem in getting custody?

The fact that you "pretty much raised" someone else's child since the child's birth does not give rise to any rights of ownership. Bottom line: it is not YOUR child; rather it is the parent's child. And you are merely an "non-parent" (notwithstanding your have pretty much having raised the child since birth).

The question in your situation is: What is the legal basis for now denying to an otherwise fit parent the natural right custody of his/her child. even though the parent has up-to-now allowed somebody else to raise the child? IOW, what is it about the parent that should compel a judge to deprive the parent of the right to have the custody of his/her child?
