Legal Question in Family Law in Oregon
My husband filed for divorce in California on 09/04/209, I currently live in Portland Oregon. Our divorce should have been finalized on 03/05/2010. It has yet to be completed. I want to get remarried, but can't get in touch with my husband to complete the divorce. I feel like my hands are tied. What can I do? Someone at the courts office in California emailed me and said "There has been no movement since it was served. In order to finish the case he will need to finish by way of default or you can file a response and finish the case yourself. If you file a response and do not have an agreement between the two of you a hearing will need to be set. It is much easier to complete if he finishes the case." Can you please tell me what this exactly means?

You need to hire a lawyer in California to get the California divorce case finalized, either by way of dismissal for lack of action, or affirmatively with a Judgment of Dissolution of Marriage. Much depends on the present legal posture and status of the case (Has then been a signed Marital Settlement Agreement, etc.?) and the procedural rules of the California court in which the case is pending. An Oregon attorney (me) is not going to be of much help with resolving a California devorce.
