Legal Question in Family Law in Oregon

My husband and I have not lived together for almost 2 years. We currently reside in the same city in Oregon. We have a 4 year old son together. We have not filed for divorce, nor are in custody arrangements drawn up. I would like to take our son to his family's in Nebraska. He says we cannot do this. I am wondering if I legally can?

Given that there is no legal action presently pending for divorce or legal separation, you are free to take your child and relocate to Nebraska (or any other place, for that matter). Husband, of course, has an equal right to take the child and move any other location of his choosing. Essentially, the child is up for grabs. Until and unless a court order has been obtained saying otherwise, each parent is free to snatch the child from the other parent.
