Legal Question in Family Law in Oregon
My husband has an ongoing case with his ex-wife. She started the dissolution of marriage about 6 years ago she was the petitioner and he is the respondent The case has been ongoing with child visitation and whatnot. We just filed something to the court and he seems to think that since we filed that, that he is the petitioner now, I dont think he is right, please clarify.
thanks

ANSWER:
For purposes of all legal documents filed after the initial petition or complaint, the parties retain their same legal positions. The respondent, for example, remains the respondent, even when it is the respondent who is filing a post-judgment modification motion.
