Is it legal for my child and I to move?

I am a 20yr. old mother of a 15month old son who lives in the same town as the baby's father. We were never married but his name is listed as the father on the birth certificate. We lived together for 2yrs in Colorado and have lived together for almost 2 yrs in Oregon until recently when we decided to split. We have been sharing visitation between us with our son. I would like to start over again in a town 2hrs away where my mom and sister live. My question is: Is it legal for me to take my son and move us to another town? I have a place to live and a job waiting for me. Please help me so that I can make a new life for my son and I. Thank you.

YOUR QUESTION:

ANSWER:

YES, it is legal for you to take your son and move to another town. At least until and unless there is a court order that says otherwise. (I am presuming, from the facts you describe, that no such court order presently exists.)

The mere fact that you and the other parent have been "sharing visitation" (doing so by informal agreement, there being no court order) does not give rise to any limitation on you to change the arrangement at any time.
