Legal Question in Family Law in Oregon
Legal Guardianship w/single parent custody
Looking for attorney who has experience with legal guardianship and could file the proper papers. Case will be single mother consenting to grandparents becoming legal guardians. Child has been living with grandparents for six months. Child has been reported on grandparents tax returns. Grandparents provide all support including medical costs. Single parent (no father on birth certificate) lives out of state. Any special considerations or issues I should be aware of? Fee? Thank you in advance.

Re: Legal Guardianship w/single parent custody
109.056. Delegation of certain powers by parent or guardian; delegation during period of military service. (1) Except as provided in subsection (2) or (3) of this section, a parent or a guardian of a minor or incapacitated person, by a properly executed power of attorney, may delegate to another person, for a period not exceeding six months, any of the powers of the parent or guardian regarding care, custody or property of the minor child or ward, except the power to consent to marriage or adoption of a minor ward.
Why do you need a lawyer to do what you can very well do for yourself without a lawyer?
Take a look at ORS 109.056 re "Temporary Delegation of Parental Rights and Authority":
(1) A parent or a guardian of a minor or incapacitated person, by a properly executed power of attorney, may delegate to another person, for a period not exceeding six months, any of the powers of the parent or guardian regarding care, custody or property of the minor child or ward, except the power to consent to marriage or adoption of a minor ward.
