Legal Question in Family Law in Oregon
Legal Guardianship
Hi, I have legal guardianship of my 15 year old grandson and have since he was 6 months old. My grandson has an aunt and uncle that are a huge part of his life and all agree the grandson should live with the aunt and uncle. What legal steps must I take to transfer legal guardianship to the aunt and uncle. I would greatly appreciate any help on this. I am in Oregon and the Aunt and Uncle are in California.

Re: Legal Guardianship
Easiest thing is for you to continue as guardian and give formal consent to the 15-y/o boy to go live with the aunt and uncle in California. Keep in mind that he will be an adult within 36 months (at age 18) and will no longer be subject to or have any need for a guardian.
Oregon law allows you to execute a tempoary "power of attorney" that will delegate to another person (or persons) the right to have the child living with them and allow them to consent to medical treatment, etc. The power of attorney is good for only six months but can be renewed and extended for successive six-month terms. So you simply do this until child attains age 18.
My office charges a nominal fee ($50) for the preparation of this document.
Other lawyers may charge more, some less.
