Legal Question in Family Law in Oregon

marriage

You get a marriage license from the county court house.You get married, everyone signs the document but it is never sent back to the county to file. Is the marriage legal? Would you have to divorce?

Your question is more complex than it may appear on its face. The question is who neglected to record the marriage license. If it was the person solemnizing the marriage failed to file the license then the marriage is valid. The best approach is to get a court order that either the marriage void or that the marriage has been dissolved by court order.
