Legal Question in Family Law in Oregon

medical expenses

In my divorce papers it states I'm resposible for 50% of all uninsured medical expenses.I have my children on my medical and do not get credit for this.My ex does not have them on medical. So my question is since they are insured am I still responsible for 50% of medical?

Re: medical expenses

Yes, you are responsible for 50% of the uninsured medical. In order to receive credit for the cost of covering the children, you need to request a modification of child support. You then receive a credit for a portion of your out of pocket costs for the insurance. Remember, sometimes if you request a modification of child support and your income has increased or the children's mother has a reduction in her income, child support can actually increase even if you receive credit for your costs of providing health care. Be sure to review the child support calculation which is available on line through the State of Oregon.gov webpage. Good luck.
