Modification for spousal support in OR

My husband was ordered to pay spousal support to his ex wife for a period of 7 years. She was unemployed at the time and was not going to be finished with her 4 year degree for a few more months. My husband did not have the best representation...his attorney was not organized and many items were not brought up during trial that my husband wanted reviewed. My husband's ex wife married her live in boyfriend after signing the decree. She was pregnant and now has a child with him. She has not made an attempt to obtain work using her 4 year decree. She sold the condo for a great deal more than it appraised for during the divorce. She and her husband bought a new home and moved to WA. She has not given my husband her new address. Their daughter moved out of her mother's home and is living on her own. My husband pays child support while she is attending college and also pays half of her school. My husband's ex is not fulfilling her obligation to pay half of school and does not pay any child support. My husband is being transferred in his job, taking a cut in pay and will have an increase in living expenses due to the area. We are married and I have 2 boys. Can we get the support reduced or eliminated. She won't get a job.

ANSWER:

Much depends on other facts and circumstances. For how long have they been divorced? How much is he paying in spousal support? And for how much longer? And how much is he paying in support for the adult daughter attending college? Does the divorce decree expressly declare and order mother to pay support to the adult offspring attending college?

In any event, given the facts of this situation and the cost for attorney representation, it may not be cost-effective to proceed. A lawyer would need a lot more info in order to properly evaluate the case and rendered an educated and informed opinion, and provide the counsel and advice you are seeking.
