if the mother and father were never married to one another but do have a mediation agreement regarding visitations, can the mother get married to a marine and just move out of state with the child?

Yes, in the absence of a COURT ORDER that bars such a move, she is free to do as she wants. The "mediation agreement" is not a court order and is not judicially enforceable.
