Legal Question in Family Law in Oregon

Non Custodial Visitation - Interstate

My ex-wife and I were divorced in the State of Oregon. Prior to it being finalized she moved with our daughter to Wisconsin. Since then I have relocated to Washington.

I need to contact a lawyer regarding her threat to cut-off my visitation rights. Do I need to pursue this in Oregon or Wisconsin? Can it be handled by a lawyer in Washington? Thank you.

Re: Non Custodial Visitation - Interstate

You did not say whether the matter has now been finalized. Oregon is the best place to pursue things, but you may have already lost advantage by moving to Washington. I suggest you contact an Oregon family law attorney as soon as possible (who is familiar with the laws mentioned below), and depending on his advice, perhaps move back to Oregon. This is assuming, of course, that you would rather not have to fight the matter in WI.

The issues you are dealing with are the UCCJA and the PKPA. The Uniform Child Custody Jurisdiction Act (UCCJA) has been adopted by all states and is very specific about jurisdiction of custody matters. You may read the OR UCCJA, ORS 109.700 to 109.9307 RCW, at http://landru.leg.state.or.us/ors/109.html.

The Parental Kidnapping Prevention Act (PKPA) is federal law, 42 USC 1738A, and is found at http://www4.law.cornell.edu/uscode/28/1738A.html.
