Legal Question in Family Law in Oregon
My oldest daughter is not mine biologically, but when she was born, the hospital put my name on her birth certificate, since her mother and I were married. A few years after she was born, my now ex wife left me, and moved away. She gained custody of both girls, by lieing on the custody papers when she filed divorce. Anyway, I have had no real contact with my oldest, for over 8 years. She is 13 years old, lives with her mom, and calls another man dad (her real dad to be exact) she has opened up lines of communication with him. While I am paying child support for a daughter that is not mine, and she has reestablished a relationship with the BIOLOGICAL father. How can I now, get my name removed from the birth certificate, so I can remove myself from having to pay child support on her?

At the time of the divorce, why did you not raise the issue of your nonpaternity as to the older child? That would have been permissible and the issue could have then been resolved as part of the divorce proceeding. In sum, you are seeking to do now what you could and should have done then. Given the passage of time, the legal opportunity for you to obtain a judicial declaration of nonpaternity has long ago past. Unless there is something more to the story than presented here, I do not hold out hope of being relieved of the child support obligation.
