Re: Order of Dismissal and divorce decrees
YOUR QUESTION:
Does Oregon remove a final divorce decree of less than 6 months with an
Order of Dismissal?
ANSWER:
NO. A Judgment of Dissolution of Marriage terminates the legal relationship of husband and wife immediately as of the date of judical signing. Thereafter, if the parties want to reconcile, they need to get a new marriage license and get married all over again. (Nonetheless, as a practical matter, most judges in Oregon are willing to sign a Judgment Vacating Prior Judgment, upon stipulation of both parties, if presented to the judge within 30 days after the date of decree.)
