If neither parent has custody, (the father has the child for majority) can the mother move out of state without consent?

Assuming I understand correctly that there is no existing court order regarding custody, then what would stop her? Who says she must get your consent? Best thing for you to do is to start a custody proceeding and get a temporary order in place that prevents her from moving the child out of state until the proceedings are completed. Then you can probably get a notice requirement put into the custody judgment. But be prepared to deal also with child support issues which may be raised as part of the proceedings.
