Paternity & Child Support

My wife and I are still married and have been seperated for 7 of the 10 years of marriage. My wife had twins in OR. and I was put on the birth cert. as father. We are both in agreement that I am not the biological father and now she is trying to file for child support. How can I get off the birth certificate so I am not financially responsible for her twins?

This is not an easy task, and most Oreogn lawyers will not know how to deal with this problem. Many will likely refer you to me, since I am more knowledgeable on this topic than any other attorney in this state. (I wrote the chapter on Paternity Law in the Ore State Bar "Family Law" handbook.)

Anyway..... In answer to your question as to how you get off the birth certificate so you are not financially responsible for her twins....

The remedy in your case (short of now filing for divorce and obtaining a judgment of nonpaternity as part of the divorce proceeding) is to file a legal action seeking a Declaratory Judgment, pursuant to ORS chapter 28.
