power of attorny

Hi, my boyfriend of 4 years had passed away 2 months ago, his mother has been claiming power of attorney. Now since he never filled out a form or anything to grant her power of attorney, can she claim this?

A power of attorney dies when a person dies. The administrator or surviving next of kin is able to make decisions regarding his property and possessions.
