pregnant but..
Hi, so me and my husband are seperated and im pregnant with another mans child. I know the hospital already assumes and must put my husbands name on the birth certificate however i was wondering what the steps were to getting the real fathers name on the certificate and how hard is it? My husband is in iraq right now and will not be home for awhile so without him here is it going to make it more difficult to get this all done?

After the child is born, you need to file a lawsuit asking the court to render a judgment that "deestablishes" your husband's "presumed legal paternity" of the child and declares and establishes the biological father as the child's legal father.
Upon a court-certified copy of the court's judgment being sent to Vital Records, the child's birth certificate wiill then be changed, per the court's judgment.
This is a rather technical area of law with which most Oregon attorneys are not familiar. Indeed, most of them end up calling me for advise on what to do!
