Legal Question in Family Law in Oregon

Pre-School

I am the custodial parent and my ex-husband has the children every Sunday and Monday night. He is not taking them to their private Pre-School on Mondays because he says it is daycare and he can provide his own daycare on his day. However, he is just keeping them at home. The children are enrolled and both of us have paid the tuition for the year. This is effecting my children's education. What rights as a custodial parent do I have to ensure that my children have the opportunity to fully participate in pre-school?

It probably depends on what your parenting time agreement specifically says. Aside from that however, are they suffering physical or emotional harm by not going to pre-school on Mondays?

MY ANSWER:

Your right is to take the matter back to court, if you are unhappy with the existing parenting time arrangement, and ask the judge the modify it so as to make the adjustments you believe to be in the best interests of the child.
