Legal Question in Family Law in Oregon

responsible for debts when separated?

My wife and I have been separated for 3 years. This is not a legally documented separation. How can I prevent any financial responsibility for debts she incurs? For example, if she does not pay the mortgage on our jointly-owned house, or doesn't pay her personal bills?

Thank you very much.

Re: responsible for debts when separated?

Your financial responsibility for joint debts is with the lender. If you are jointly responsible for any loans, and your wife takes out new debt, you will still be jointly responsible. You should contact each lender who you have joint credit with and freeze or close these accounts. In order to divide your jointly held mortgage, you will need to file for a divorce or a legal separation. These documents are available at the Oregon web site under self help forms or you should contact an attorney in your area.
