Legal Question in Family Law in Oregon

Reversal/Annulment of Divorce Decree

I live in Oregon. If both parties request to have a divorce ''undone'' is this possible? The reasons for seeking the divorce were actually unfounded. Thanks for your time.

Re: Reversal/Annulment of Divorce Decree

The only "reasons" (legal grounds) for getting a divorce under Oregon law are "irreconcilable differences." To get the divorce, one or the other of you must have made a sworn declaration to the court to that effect. For you to now go back to the court and say that the reasons for seeking the divorce were actually unfounded amounts to your telling the court that you lied under oath when originally swore to the existence of "irreconcilable differences." Are you sure you want to do that??

All things being considered, it may be cheaper, quicker and easier to just get married all over again.

But in answer to your main question: YES, it is POSSIBLE to set aside or vacate a Judgment of Dissolution of Marriage, depending on a number of various legal conditions, the length of time since the divorce, and the particular facts and circumstances of your case.

Best advice is to confer with a lawyer and obtain some professional consultation and advice.
