Legal Question in Family Law in Oregon

spousal modification

I want my support changed to the first of each month. I now receive it the 1st and the 15th. What does this entail for an attorney?

Re: spousal modification

Support is generally paid on a monthly basis, with one specific day of the month being designated as the "DUE" date for support accural and record-keeping purposes. And this is true even if the total monthly obligation is "PAYABLE" in two (or more) segments within the month (such as 1st and 15th day of the month).

So long as the full monthly amount ends up being paid and received within the calendar month for which it is due, the court will generally not get further involved in the matter, nor will the court change the payment arrangement. (In essence, the court's attitude is "If it ain't broke, don't fix it.")

Should you need or desire further legal counsel and advice, you may contact me and we can then schedule an office conference to further evaluate your case facts and circumstances.
