What state's laws do we follow for divorce in Oregon?

I was married in Louisiana in 2002, but live in Oregon with my husband (I am a Louisiana native, he is a Northwestern raised guy).

My question is; what state's laws do we abide by if I decide to file for divorce?

YOUR QUESTION:

ANSWER:

The controlling law will be the law of the state in which the divorce action is filed. Every state has a residency requirement as a prerequisite for filing to divorce. In Oregon, one of the spouses (doesn't matter which one) must have lived in this state continuously for six months before a divorce lawsuit can be filed (and it makes no difference which spouse files the lawsuit). If filed in Oregon, Oregon law will control.
