Step parent adoption

My husband is paying child support to a woman he had a one night stand with a few years back, before we met. He has never met the child, and doesn't want to do so. Also, the woman is now married to a man who is able to provide medical benefits for the child, yet the state is continuing to take the money from my husband's check ($90 per month)and she really doesn't need my husband's insurance. The woman's husband wants to adopt and we have agreed to pay all legal fees (which we already have paid 1K for both attorneys' retainers). Now the woman is dragging her feet and may not go through with the step parent adoption. We have evidence that she started this process (emails, etc). My question is this: Can we take her to small claims court and sue her for the $1000 in retainers since it was her who started this and now may back out? We already pay a ridiculous amount of support, but now we are out $1000 ''extra'' because of her fickle behavior. Thanks for your response.
