Legal Question in Family Law in Oregon

Switching Custody

Right now, my ex wife has custody of our 2 boys. Lately, the oldest ( 16) has expresed that he wants to live with me. My ex and I live 5 blocks apart so he wouldn't be moving very far. My ex and I talked about it and agreed that it would be ok. My ex came to my house and her and I typed up a letter stating that as of September 8, He moves back home with me. My question is 1) How do I go about to make me the custodal parent and 2) How would I change the order for child support.

Thank You

Re: Switching Custody

Contact your county family courthouse. There is a form that you can use on the State of Oregon Web page/ family law forms. Some of the counties have self help form and the local staff can help you complete the forms. You will need to complete the form, both sign it and turn it into the court records. This will also change your child support obligation, but until you submit the change to the court, you will still have support payments coming due. You did not talk about child support, but this is often an issue that remains. You may still agree to have joint custody, but you would be the residential parenting making the day to day decisons. Good luck
