Legal Question in Medical Leave in Oregon

I requested 5 days off using my accrued vacation time. When they found out there was a family medical issue involved, I was asked to apply for FMLA. I am not asking for time off to take care of anyone. My spouse will be in the hospital during this time. If things go badly, I might need FMLA later. Can they ask me to "burn" a week of FMLA?

It seems like they should have to exhaust your paid benefits before taking a loss with FMLA. Why they would be fighting it I don't know.
