accused of shoplifting
My 16 yrs old daughter was accused of shoplifting at a local grocery store over a month ago. She had purchased two candy bars at school & was at the store to purchase a bag of chips before going to work. She did stop to look at the candy bars, picked up one & replaced it. She paid for her chips & left the store. She was then approached by a man who grabbed her bag & removed the candy she had from school. The security person called us, took several pictures at her request to not to until her father was present. The officials were not called. She was told to not return to the store or would be cited for trespassing. She is a honor role student, has her own checking acct, has a job & never had any trouble before. We were furious! I spoke with the security person & the store manager to plead the wrongfulness of this accusation. Now, a monthlater, we have a letter demanding $101 citing ORS 30.870, 30.875. Do we have to pay this? They took the candy the belonged to her & now we have to pay them for the false accusation? If we do not pay & they attempt to sue, will that not cost us more. How do we proceed?

You should contact an attorney with vast experience in these cases, Greg Kafoury. He has handled many similar cases, has gotten the charges dismissed, and has sued the store for "false arrest" of the alleged shoplifter.
