Legal Question in Civil Litigation in Oregon

Borrowed Car

My question is

If someone borrows a car that has 180,000

miles on it and drives it less that 400 miles and the transmission goes out, is

the person who borrowed the car responsible for 100% of the repair bill?

Thank you --name removed--

Re: Borrowed Car

Your question does not really have a clear-cut answer without additional information.

The liability for repair of the transmission would depend on several variables, including, but not limited to:

1. What was the agreement between the borrower and the owner regarding repairs (if any)?; and

2. Was the damage to the transmission caused by the borrower by misuse or a failure to maintain the equipment?

Merely borrowing a vehicle for a short period of time does not necessarily make the borrower liable for repairs.
