Legal Question in Civil Litigation in Oregon
I bought a used car in Oregon and the seller lied to me. He stated both verbally and in writing that the vehicle had a rebuilt transmission and it does not (per an inspection done after the purchase). I offered to return the vehicle and he refused. What are my legal options?

You can sue him for recission of the contract (he gets back the car, you get back your money) or for damages (he pays you the difference between what the car is worth and what you paid for it), based upon the fraudulent misrepresentation of the qualities of the car. Do you really have it in writing that the transmission was rebuilt? It is rare that false representations will be in writing. Was the writing signed by the seller? If not signed by him, can you prove he wrote it?
