Faulty concrete driveway

We are anticipating a lawsuit against a contractor who poured our driveway two years ago. The driveway has cracked quite extensively. They made many promises, but still have no solution. At the time the work was done, the contractors were a pair of brothers who have now separated and each have formed their own construction company. Will this affect our law suit?

The probable only effect of this change might be as to who or what entity you sue or claim against.
