is it illegal for a non profit buisness to throw away items that have been donated and given a tax paper so that it can be written off on the persons taxes at the end of the year/

No. But it is not legal for a nonprofit charitable entity to provide to the donor a false statement of the fair market value of the donated items. If the items were to be immediately trashed anyway, then their value was zero, and the donor should not take any tax deduction for having donated them.
