Judgment

There is a possibility that I could lose a $100,000 lawsuit. This will bankrupt me. Can I file bankruptcy?

It depends on the basis for the lawsuit. There are some debts that are not bankruptable, but overall those are rare. It is more typical that you can bankrupt out of a judgment.

Fairest thing to do is to alert the attorney who is representing you, because if you owe him or her money, then that attorney becomes a creditor of yours and his or her earned fees are going to be dischargeable.

Then, go talk to local bankruptcy counsel. You might want to look at avvo.com ( a v v o) for some information on local bankruptcy attorneys. That lawyer can tell you precisely whether the judgment you are facing is dischargeable or not.
