Legal Question in Civil Litigation in Oregon
Lemon Laws/Recalls
My mother bought a Saturn Vue
from the dealer 5 years 2 months
ago. It's now exactly 2 months over
the warranty. The car only has 80K
miles and her transmission just froze
up. She took the car to the dealer
for help and they asked why she
didn't take advantage of the recall on
all `01-`05 Saturn Vue
transmissions and engines. Of
course to take advantage of this
recall you had to act before the
warranty expired. She had never
received any notices or any form of
communication explaining this recall.
She'd never heard of it at all. When
she asked for their help they kind of
laughed and said for a whopping fee
of $$$ they'd gladly help her. Was
she sold a lemon? How are these
recall notices supposed to be issued?
Is there grounds for legal action

Re: Lemon Laws/Recalls
A car that has run for 5 years without major problems is not a lemon, and state law does not entitle your daughter to anything from the dealer.
Under Oregon law, a lemon car is one that requires repeated repairs within the first year or 12,000 miles.
