Legal Question in Civil Litigation in Oregon

Liability in ATV accident

I was in a collision on an ATV that did not belong to me. The other person says he will sue for me to fix his ATV. Not the one I was using but the one I collided with. I know this person and as far as i am concerned it was an unfortunate accident. The only injuries were mine. His cost for parts is around 320.00 dollars. No insurance on either of the ATV's. Does he have a case?

No insurance?

Your liability to him depends on who was at fault in causing the accident. Were you at fault? Did you cause the accident by negligence (not paying enough attention to what you were doing)? If so, then, yes, he has a case against you for repair costs and also for his medical costs, lost income (if it caused him not to go to work), and even pain and suffering.
