Legal Question in Civil Litigation in Oregon

Removal of neighbor's tree

My neighbor believes I have removed 2 trees that were beginning to block my view across his property and has accused me of such. These trees were planted after I began construction of my home and well after I specifically asked him if they had plans of any type to block our view to the east. How would such an accusation be handled? As a civil issue, or a criminal issue? If found guilty, what would be the most likely remedy? These trees were approx 11 years old and appeared to be diseased or damaged. They were approximately 12 feet tall.

Re: Removal of neighbor's tree

You neighbor could be entitled to civil remedies for the alleged timber trespass. Under Oregon Law the remedy is 3 times the value of the tree plus attorney fees. This is a fact specific issue. I suggest that you contact an attorney for advice.
